The petitioners are apprehending arrest in a case registered for the offences punishable under sections 147,148,149,323,324,307 and 504 of the Indian Penal Code. It is alleged that co accused Md. Murtuza caused injury with knife to the brother of the informant namely Md. Ibadat whereas co accused Md. Shahnawaj assaulted with farsa to the informant and co accused Sabir assaulted with knife to Naushad.

It is submitted by the learned counsel for the petitioners that specific overt act has not been alleged against these petitioners though they are alleged to have caught hold the

Patna High Court Cr.Misc. No.53216 of 2015 (2) dt.23-11-2015 2/2 informant and others. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. More over, opinion has been kept reserved with regard to some injuries. The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioners by the learned court below in case the petitioners surrender within six weeks from today in connection with Supaul P.S. Case No. 376 of 2015 pending in the court of learned CJM, Supaul. This application is disposed of with the aforesaid observation/direction.
