The petitioners apprehend their arrest in connection with Habibpur P.S. Case no. 85 of 2017, registered under Sections 147, 148, 149, 448, 323, 324, 307, 354 and 379 of the Indian Penal Code.
The accusation is that 11 persons named in the F.I.R. including the petitioners, came at the door of the informant and started to abuse. At that time, Md. Lallu gave iron rod blow at the head of Md. Alamgir, husband of the informant, when Chandi, daughter of the informant, came in rescue then she was also assaulted through bricks by Afshan. At
Patna High Court Cr.Misc. No.8895 of 2018(2) dt.17-02-2018 2/2 that time, Lallu snatched silver chain of the informant. Learned counsel for the petitioners submits that specific allegation is against Md. Lallu to cause injury at the head of the husband of the informant and causing injury at the daughter of the informant is against Afshan. Further submission is that while petitioners are named in the F.I.R., but no specific overt act has been levelled against the petitioners. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M-XII, Bhagalpur in connection with Habibpur P.S. Case No. 85 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
