The petitioner apprehends his arrest in connection with Madhepur P.S. Case No. 43 of 2016, registered under Sections 406, 409, 420, 467, 468 and 120(B) of the Indian Penal Code.
Learned counsel for the petitioner submits that similarly situated co-accused persons, namely, Amrendra Kumar, Rabindra Nath Raju, Binay Kumar Jha and Satya Naryana Yadav have already been allowed bail by coordinate Bench of this Court vide Criminal Misc. Nos. 736 of 2017, 189 of 2017, 2796 of 2017 and 849 of 2017 respectively. Further submission is that petitioner has no criminal antecedent.
Having considered the facts and circumstances of
Patna High Court Cr.Misc. No.54904 of 2016 (7) dt.10-05-2017 the case, let the petitioner Ali Moosa be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Jhanjharpur (Madhubani) in connection with Madhepur P.S. Case No. 43 of 2016 subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Arvind Srivastava, J) S.Sb/- U T
