Petitioner is apprehending his arrest in connection with Bikram P.S. Case No.44 of 2017 for the offences under Sections 341, 323, 307, 379, 504, 34 of the Indian Penal Code. Learned counsel for the petitioner submits that there is case and counter case with injuries having been inflicted on both sides. He further submits that there is dispute with regard to the settlement of a piece of land in favour of the younger brother of this petitioner who is a retired Ex Army Officer and for which proceeding under Section 133 Cr.P.C. has already been initiated. Considering the fact that there is case and counter case in between the parties and there is history of the dispute of land,
Patna High Court Cr.Misc. No.35875 of 2017 (2) dt.16-08-2017 2/2 let the petitioner, above named, in the event of his arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri R.N.Singh, J.M. 1st Class, Danapur, in Bikram P.S. Case No.44 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C.
