Heard counsel for the petitioners and counsel appearing on behalf of the State.

The petitioners are apprehending arrest in connection with C.R. Case No. 27 of 2019 for offences under Sections 341, 323, 313, 379, 498(A), 454, 504, 506, 34 IPC and 3⁄4 Dowry Prohibition Act.

Allegation against the petitioners in the complaint petition is that they have treated the opposite party No. 2 with cruelty for non-fulfillment of dowry amount.

Patna High Court CR. MISC. No.22939 of 2020(4) dt.02-03-2021 2/2 Learned counsel for the petitioners submits that the petitioners have no criminal antecedent. The petitioners are father-in-law and mother-in-law of the complainant. The petitioners are living separately in mess and business from the husband of the complainant and statement to that effect is made in para-14 of the bail application.

In view of the statement made in para-14 of the application, the Court is inclined to grant privilege of anticipatory bail to the petitioners. Let the petitioners, above named, in the event of arrest or surrender within four weeks from the date of communication of the order, be released on bail on furnishing bail bond of Rs. 50,000/- (Fifty Thousand) each with two sureties of the like amount each to the satisfaction of the SDJM, Madhubani in connection with C.R. Case No. 27 of 2019, subject to the conditions as laid down under Section 438(2) Cr. P. C. and further subject to the condition that the petitioners shall produce documentary or other evidence regarding separate mess and business from the husband of the complainant before the Court below at the time of surrender.
