The petitioner seeks bail in anticipation of her arrest in connection with Nawada Town P.S. Case No. 67 of 2021 instituted for the offence under Section 304 of the Indian Penal Code.

The petitioner is a Doctor, who had operated upon the patient (deceased) whereafter a healthy baby was delivered by her. Later, she suffered some complications for

The informant suspects negligence at the hands of the petitioner, which perhaps led to complications. The learned counsel for the petitioner has submitted that an absolutely false accusation has been levelled against the petitioner. The operation conducted by the petitioner was successful. It was only after the delivery of a child that the deceased suffered some complications for which she was referred to a hospital with better facilities, where she died. There is nothing on record to indicate that the petitioner had been negligent in attending of the deceased.

For the reasons afore-stated, the petitioner, above named, is directed to be released on bail, in the event of her arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate,
