JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-07-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 325, 307, 354, 379, 504, 506 of the Indian Penal Code. It is alleged that this petitioner along with other accused persons and 6-7 unknown persons assaulted the informant and his family members. It is further alleged that during the course of assault, the accused persons snatched mangalsutra from the neck of Arti Devi and also snatched Rs. 1,000/- from the pocket of the informant.
It is submitted on behalf of the petitioner that this petitioner assaulted the informant with iron rod. Doctor has found simple injury. Petitioner claims clean antecedent. Learned counsel for the State opposes the bail petition

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Bagaha, West Champaran in connection with Thakraha P.S. Case No. 9 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
