JUSTICE ARVIND SRIVASTAVA ORAL ORDER 10-10-2017 Heard learned counsels for the petitioners and the State. Petitioners apprehend arrest in connection with Bidupur P.S. Case No. 113 of 2012 registered for the offence punishable under section 302 and other allied sections of the Indian Penal Code.

Learned counsel appearing for the petitioners submits that petitioners had earlier moved this court for grant of bail which was rejected vide Annexure-2. Learned counsel further submits that other co-accused persons have been acquitted by the Court below vide judgment contained in Annexure-3. Learned counsel as such prays for grant of bail to these petitioners. Learned Addl. P.P. appearing for the State submits that

Patna High Court Cr.Misc. No.36721 of 2017(4) dt.10-10-2017 2/2 since charge-sheet has been submitted in this case showing these petitioners to be absconder, the present anticipatory bail application is not maintainable.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, this application is dismissed as not maintainable.
