2. The petitioner seeks bail in connection with Raniganj P.S. Case No. 07 of 2025 registered for the offences under Section 310 (2) of the Bharatiya Nyaya Sanhita.

3. The petitioner is not named in the F.I.R. and is in custody since 13.01.2025.

4. The allegation against the petitioner is to commit dacoity and while committing so looted cash of Rs. 2,41,000/- from the informant.

5. Learned counsel appearing on behalf of the petitioner submitted that merely on the basis of mobile tower

No.24489 of 2025(3) dt.24-07-2025 2/3 location petitioner was apprehended in the present case, where after his self-confession was recorded consisting of inculpatory statements. It is submitted that in furtherance of his self-confession, nothing incriminating appears recovered/surfaced during the course of investigation so as to connect petitioner prima-facie with the present occurrence. It is pointed out that alleged cash of Rs. 15,000/- which was said to be recovered from the house of the petitioner belongs to him and same cannot be connected with looted cash in want of details and denominations. It is also submitted that petitioner was not put on TIP as yet. While concluding the argument it is submitted that petitioner is a man of clean antecedent and moreover, investigation has been completed, for which, charge-sheet has been submitted, as such, there is no chance of tampering with the evidence.

6. Learned APP appearing on behalf of the State, opposes the prayer for bail.

7. In view of aforesaid facts and circumstances as mentioned above and by taking note of the fact as implication of petitioner prima-facie appears on the basis of suspicion

No.24489 of 2025(3) dt.24-07-2025 3/3 arising out of self-confession, where recovered Rs. 15,000/- prima-facie cannot be connected with alleged looted cash of Rs. 2,41,000/- in want of details and denominations, coupled with the fact as petitioner is in custody since 13.01.2025 , accordingly above named petitioner, is directed to be released on bail in connection with Raniganj P.S. Case No. 07 of 2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st Araria/concerned court, subject to the conditions as mentioned under Section 480(3) of the B.N.S.S.
