The petitioner apprehends his arrest in Chhatapur P.S. case No. 256 of 2016 under Section 304B/34 of the Indian Penal Code and under Section 3⁄4 of Dowry Prohibition Act. The informant, of course, named the petitioner and alleged that petitioner along with other family members killed his daughter.
The learned counsel for the petitioner submits that petitioner is cousin brother-in-law of the deceased and he has no manner of concern with the family affairs of the deceased or her husband. The informant did not make any specific allegation against the petitioner.
Considering the facts aforesaid and the nature of
Patna High Court Cr.Misc. No.45779 of 2016 (2) dt.25-11-2016 2/2 allegations made against the petitioner and the fact that petitioner is cousin brother-in-law of the deceased, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Supaul in Chhatapur P.S. Case No. 256 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
