JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 28-09-2021 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State. Learned counsel for the petitioner undertakes to remove the defects within four weeks of resumption of normal court proceeding. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench. The petitioner seeks bail in connection with Begusarai Muffasil P.S. Case No. 137 of 2021 registered for the offence punishable under Sections 324, 307, 302, 120 (B), 34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner is that petitioner along with other family members including father, stepmother of the informant had killed husband of the informant. It is alleged that the reason

Imteyaz (deceased) out of love and against the wishes of her family and was residing with him which was not liked by her family members. Therefore, she raised suspicion that petitioner along with other family members had murdered her husband.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case and has not committed any offence as alleged in the FIR. He submits that petitioner is the stepmother of the informant. Learned counsel while reciting the contents of the F.I.R., has tried to show that the petitioner is a lady and she has been falsely implicated in this matter, as her family members, opposed the love marriage of her own daughter with one Md. Imtiyaz, the deceased. He submits that no substantive material was collected during the course of investigation to connect the petitioner with the case and only on suspicion she has been made accused in this case. The allegation levelled against the petitioner is not specific rather general and omnibus in nature.

The petitioner has no criminal antecedent as has been mentioned in para 3 of this bail application and she is languishing in custody since 05.03.2021.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor Court in connection with Begusarai Muffasil P.S. Case No. 137 of 2021.
