The petitioners being the uncles and brother-in-law (Bahnoi) of the husband of the victim are apprehending their arrest in a case registered for the offences punishable under Sections 304B/201/34 and 120B of the Indian Penal Code.

The accusation is of killing the daughter of the informant after two years of the marriage for non-fulfillment of the dowry demand.

It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.53297 of 2015 (2) dt.23-11-2015 2/2 petitioners that the specific accusation of demand of dowry and inflicting torture has been levelled against the husband of the victim, who is in custody. Petitioner nos. 1 and 2 claim to be separate from the husband of the victim and petitioner no. 3 is resident of different village. Subsequently, the informant has retracted from the initial version and filed a petition to that effect before the learned court below.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Phesar P.S. Case No. 39 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
