The petitioners seek bail in anticipation of their arrest in connection with Bhargama P.S. Case No. 63 of 2016 dated 27.05.2016 instituted for the offences under Sections 341, 323, 379, 354(B), 324, 307, 504 and 506/34 of the Indian Penal Code.

With respect to a dispute intra-family, an occurrence took place in which one Maheshwari Mehta, brother-in-law of the informant and his son are said to have assaulted the informant and had also made an attempt to disrobe her. Later, these petitioners are also alleged to have come to the house of the informant and

The police during investigation did not find the accusation against the petitioners to be correct and hence submitted final report false as against them. However, the learned court below, differing with the police report took cognizance against the petitioners also. The injuries suffered by the informant are said to be simple in nature.

Considering the fact that there is intra-family dispute because of rival claims over a plot of land, the petitioners above named are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, 1st Araria in connection with Bhargama P.S. Case No. 63 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) Krishna/- Sneha U T
