JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-07-2019 This is an application for grant of anticipatory bail in connection with Arer P.S. Case No. 41 of 2017, disclosing offence under Section 27(b) (ii) of Drugs and Cosmetics Act, 1940.

Allegation against the petitioner is that Drug Inspector has raided the shop of the petitioner and found that he has running a medical shop without having any license and there is huge quantity of medicines recovered from there. Submission of the learned counsel for the petitioner is that he has license till 2016 but thereafter, he could not renew the license and the medicines were kept as he has to check the same with the bills. Further submission is that he is ready to abide by any condition imposed upon him.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of Shri Ajay Kumar- 2nd Judicial Magistrate, 1st Class, Benipatti, District Madhubani, in connection with Arer P.S. Case No. 41 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that he has to cooperate with the I.O. and appear as and when required.
