By the order dated 26.05.2015, the learned Principal Judge, Family Court, Kaimur at Bhabhua has directed the petitioner to pay Rs.5,000 per month as maintenance under Section 24 of the Hindu Marriage Act in Matrimonial Case No.139 of 2013.
From perusal of the order, it appears that the Court below, after considering the submissions of the parties and conduct of the petitioner and also recording the fact that the petitioner has got 5 bighas agricultural land and also he sells vegetables and that he has got 12 shops which are on rent, directed the petitioner to pay Rs.5,000 as monthly maintenance under Section 24 of the Hindu Marriage Act.
In such view of the matter, it cannot be said that the order
Patna High Court CWJC No.19278 of 2015 (2) dt.13-05-2016 passed by the Court below is without jurisdiction or he has passed the order in the manner not permitted by law and, therefore, it is not a case for interference in supervisory jurisdiction. Thus, this writ application is dismissed.
