Petitioner seeks bail in connection with Halsi P.S. Case No. 13 of 1998 registered for the offence punishable under Sections 353, 307, 337 and 504 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that petitioner was allowed bail by the learned CJM, Lakhisarai vide order dated 25.03.1998. Cognizance was taken on 19.04.1999, but neither summon nor any order was served upon the petitioner for his appearance and due to lack of knowledge, he could not appear before the court and his bail bond was cancelled and he was declared absconder on 19.05.2018. When the petitioner came to know about this fact, he surrendered on 06.03.2019 and since then he is in jail.

Patna High Court CR. MISC. No.24073 of 2019(2) dt.15-04-2019 2/2 Keeping in view that it is a case of the year 1998 and is pending due to non-appearance of the petitioner, this Court is not inclined to grant him bail. Accordingly, his prayer for bail stands rejected.

However, petitioner will be at liberty to renew his prayer for bail after framing of charge.
