Petitioner is apprehending arrest in connection with Rajgir P.S. Case No. 34 of 2020 for the offence under sections 30(a)(b), 37 (b)(c) of Bihar Excise (Prohibition) Amendment Act, 2016.
Learned counsel for the petitioner submits that petitioner has no criminal antecedent. He further submits that during search from the house of Bihari Choudhary 266.9 liters of liquor was seized.
It is alleged that the petitioner was among the accused persons who fled away from the house of Bihari Choudhary. Learned counsel submits that nothing was recovered from the possession of the petitioner.

No.26719 of 2020(3) dt.11-01-2021 2/2 Considering the fact that the petitioner has no criminal antecedent and nothing was recovered from his possession, the Court is inclined to grant anticipatory bail to the petitioner, let the petitioner, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-III-cum-Special Judge (Excise) Nalanda at Biharsharif, in connection with Rajgir P.S. Case No. 34 of 2020 subject to the condition that the petitioner shall deposit Rs. 50000/-(Fifty thousand) cash to the court below and the amount of Rs. 50000/-(Fifty thousand) deposited by the petitioner shall abide by final outcome of the Rajgir P.S. Case No. 34 of 2020 with further condition as laid down under section 438(2) of the Cr.P.C.
