The petitioners apprehend their arrest in Nabinagar P.S. Case No.06 of 2019 registered under Sections 429, 295A and 34 of the Indian Penal Code and Section 38(iii) of the Prevention of Cruelty to Animals Act.

The gist of the allegation that the petitioners and others killed a cow inside the house and they were cutting beef into pieces for selling. The police official on information came there and arrested two persons but the petitioners managed to flee away.

Learned counsel for the petitioners submits that the petitioners were not apprehended on the spot. There is nothing

No.24529 of 2019(2) dt.16-04-2019 2/2 on record to show that the petitioners were cutting beef for selling but it appears that the petitioners were also cutting beef after killing the cow for selling and two persons were apprehended from that place but the petitioners managed to flee away.

Having considered the facts aforesaid and the nature of allegation made against the petitioners, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the same is rejected.
