The petitioners are apprehending their arrest in connection with Sour Bazar (Baijnathpur) P.S. Case No. 197 of 2017 registered for the offences punishable under Section 379 of the Indian Penal Code.

Allegation against the petitioners is of theft of tractor of the informant and further there is demand of Rs.50,000/- from him on the assurance of returning back the tractor to him. It has been submitted on behalf of the petitioners that petitioners have falsely been implicated in this case on suspicion and nothing has been recovered from their possession. Heard learned APP also, who has opposed the prayer for anticipatory bail.

Patna High Court Cr.Misc. No.36748 of 2017 (2) dt.18-08-2017 2/2 Having heard both sides and in view of the fact that petitioners have not returned the tractor to the informant despite panchayati was held, I am not inclined to grant anticipatory bail to the petitioners.

Let petitioners surrender before the court below and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order.

With the above observation, this application is dismissed.
