The petitioner seeks bail in connection with Nabinagar P.S. Case No. 313 of 2023 instituted for the offence under Sections 341, 379, 387 & 506 of the Indian Penal Code. 3.
Prosecution case, in short, is that on 27.07.2023, while going to college, informant was threatened at gunpoint by accused Golden Das- petitioner, who demanded Rs.50,000/- monthly extortion and snatched his gold chain. The petitioner also threatened to harm informant's brother, a witness in a pending case (No. 40/22), if he testified in court. 4.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 01-02-2025. Petitioner
Patna High Court CR. MISC. No.29159 of 2025(3) dt.12-08-2025 2/3 bears twenty two (22) criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application. 5.
It has been further submitted by the petitioner's counsel that petitioner, a social activist and leader of the Bahujan Army, has been falsely implicated in the present case due to his consistent fight against police corruption and atrocities on weaker sections since 2013. Learned counsel for the petitioner submits that after exposing an illegal ultrasound racket involving police collusion, a fabricated FIR was lodged against him, despite most witnesses stating he was assaulted. The case suffers from delayed reporting, lack of CCTV or technical evidence, and prolonged investigation, allegedly to harass or eliminate him. It is pertinently submitted that charge sheet is submitted against the petitioner under Sections 341, 323, 385, 504, 506 of the Indian Penal Code, all the bailable in nature.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.
Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and charge sheet being submitted under bailable sections, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Nabinagar P.S. Case No. 313 of 2023, subject to the following conditions: (I) One of the bailors shall be own/close member of the family of the petitioner.
(II) The petitioner shall appear on each and every date fixed at the trial. In case of default in such appearance on two consecutive dates, the Trial Court will have liberty to cancel the bail bonds of the petitioner.
(III) The petitioner shall not leave the territorial jurisdiction of the court below without its prior permission. (Rudra Prakash Mishra, J) Raj Kishore/- U T
