JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-03-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Jamo Bazar P.S. Case No. 97 of 2016 registered under Sections 341, 323, 504, 307, 34 of the Indian Penal Code. The accusation is of causing assault to the informant Ravi Ranjan, Amarjeet Prasad, Bindu Devi, Dwarika Prasad and Champa Devi by petitioners and two others named in the F.I.R.

Learned counsel for the petitioners submits that in fact due to cleaning of the drainage the occurrence of marpit

Patna High Court Cr.Misc. No.2488 of 2017 (2) dt.03-03-2017 2/2 took place in which petitioners' side also sustained injuries regarding which Jamo Bazar P.S. Case No. 98 of 2016 is also lodged on behalf of father of petitioner No. 1. Moreover, only injuries with regard to Ranjan Prasad and Amarjeet Prasad have been detailed in paragraph Nos. 19 and 20 of the case diary which are of simple in nature.

Having considered the facts and circumstances of the case, let the petitioner above named, be released on anticipatory bail, in the event of their arrest or surrender before learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Siwan in connection with Jamo Bazar P.S. Case No. 97 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
