The petitioner being the husband of the daughter of the informant is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 498A, 307 of the Indian Penal Code and 3/4 of Dowry Prohibition Act.
The prosecution case is that the informant's daughter Bibha Kumari was married with the petitioner in 2009. There was some matrimonial dispute leading to registration of the case under Section 498A of the IPC wherein on the basis of the compromise the petitioner and others were acquitted. It is further alleged that on 30.04.2014 the
Patna High Court Cr.Misc. No.53701 of 2015 (2) dt.26-11-2015 2/2 petitioner came to the house of the informant for taking Bibha Devi and in the night he sprinkled kerosene oil and lit fire. Subsequently Bibha Devi died.
It is submitted by learned counsel for the petitioner that the informant has subsequently retracted from the initial version and filed a petition to that effect before the learned court below.
Considering the thrust of accusation against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner in connection with Maniyari P.S. Case No. 131 of 2014 pending in the court of learned Judicial Magistrate, Ist Class, Muzaffarpur.
Accordingly, this application is dismissed.
