JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-03-2018 The learned counsel for the parties are in agreement that the impugned order dated 10.7.2006, whereby and whereunder the respondent no.3 has illegally declared that the constitution of the Managing Committee of the School in question is illegal, has been set aside by this Court by a judgment dated 13.2.2018 passed in CWJC No. 9372 of 2006, hence the present writ petition is also fit to be disposed of in similar terms.
Patna High Court CWJC No.12540 of 2006 (9) dt.20-03-2018 2/2 Having gone through the judgment dated 13.2.2018 passed in CWJC No. 9372 of 2006, I find that the very same order dated 10.7.2006, impugned in the present proceeding, has already been quashed by this Court by a judgment dated 13.2.2018 passed in CWJC No. 9372 of 2006. In such view of the matter, I direct that the judgment dated 13.2.2018 passed in CWJC No. 9372 of 2006 shall govern the present case and all the benefits arising there from shall accrue to the petitioner herein.
The writ petition is disposed of on the aforesaid terms.
