In this case, the petitioner is seeking anticipatory bail in connection with Pirbahor P.S. Case No.35 of 2019, registered for the offence punishable under Sections 25(1-B), 26 and 35 of the Arms Act, 1959.

Allegation is that when the informant police official got information that the accused persons including the petitioner created nuisance in the Mohalla of Bhawar Pokhar Bagicha and the petitioner Mukesh Kumar is showing arms in his hand, they reached there and went to the residence of Mukesh Kumar. Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within four weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order preferably on the same day without being influenced by the order of this Court.
