JUSTICE SUDHIR SINGH ORAL ORDER 05-12-2017 Heard learned counsel for the petitioner and learned counsel for the State.
The following reliefs have been sought for by the petitioner in the present writ application.
"1.
For issuance of writ/writs, order/orders, direction/directions particularly in the nature of Certiorari for quashing the impugned Letter No.
237 dated 21.08.2014, issued by the District Magistrate, Madhepura,
Patna High Court CWJC No.15757 of 2014 (3) dt.05-12-2017 2/3 respondent no. 3, as contained in Annexure-7 to this writ application, whereby and whereunder the petitioner has been terminated from the post of Panchayat Teacher simply on the ground of there is illegality which is committed during the course of selection by the Panchayat Teacher Selection Committee under Gram Panchayat, Maura Jharkaha, BlockShankarpur, DistrictMadhepura.
(ii) For further quashing the impugned Letter No. 14 dated 29.08.2014 issued by the Panchayat Secretary, under Gram Panchayat Maura Jharkaha, Block-Shankarpur, District-Madhepura, respondent no. 8 whereby and whereunder he issued the termination letter in the name of the petitioner in the light of Letter No. 237 dated 21.08.2014 passed by the District Magistrate-cumCollector, Madhepura.
(iii) Further directed the respondents not to disturb the petitioner in discharging his duty on the post of Panchayat Teacher and stay the impugned Letter No. 237 dated 21.08.14 and Letter No. 14 dated 29.08.2014 as contained in Annexure-7 to this writ petition."
Considering the reliefs as sought for by the petitioner, the petitioner is directed to file an appeal before the District Appellate Authority, Madhepura, for redressal of his grievance within a period of thirty days from the date of the order, which shall be disposed of in accordance with law within the
Patna High Court CWJC No.15757 of 2014 (3) dt.05-12-2017 3/3 statutory period.
With the aforesaid observations and directions, the present writ application stands disposed of.
