The petitioners are apprehending their arrest in connection with Sahiyara P.S.Case No. 61 of 2017 registered for the offence under Sections 363, 366A and 504/34 of the Indian Penal Code.

Allegation against the petitioners is of kidnapping the minor girl of the informant.

Submission of learned counsel for the petitioners is that in her statement under Section 164 Cr.P.C. the victim girl has not made any allegation of kidnapping against the petitioners, rather there is allegation of abusing the informant. Heard learned APP and learned counsel for the

Patna High Court Cr.Misc. No.36684 of 2017 (2) dt.11-08-2017 2/2 informant, who have opposed the prayer for anticipatory bail of the petitioners.

Having heard both sides and in view of the facts and circumstances, let petitioners, above named, surrender within a period of four weeks before the court below and on their so surrendering they shall be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, in connection with Sahiyara P.S.Case No. 61 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition is that one of the bailors should be a local person having sufficient properties within the jurisdiction of court concerned and they will co-operate in investigation of the case and make themselves available before the investigating officer as and when required, failing which their bail bonds shall be cancelled.
