Heard both parties.
The petitioner apprehends his arrest in Khizarsarai P.S. Case No. 102 of 2020 (POCSO Case No. 43 of 2020), registered for the offences punishable under Sections 341, 323, 379, 354(B) and 34 of the Indian Penal Code and section 8 of the POCSO Act.
It is alleged that while the informant had gone to attend the natural call, petitioner and other started misbehaving with her and when her brother came for rescue then both of them fled away.
It is submitted on behalf of petitioner that petitioner
Patna High Court CR. MISC. No.24617 of 2020(3) dt.25-11-2020 2/2 has falsely been implicated in this case. In fact, there is dispute between the parties over the drainage of rain water due to which scuffle took place. Petitioner has got no criminal antecedent as stated in para 3 of the petition.
Counsel for the State vehemently opposed the prayer for bail and submitted that prosecution case is duly supported by the victim in her statement under Section 164 Cr.P.C and para 33 of the Case diary also shows that injuries have been found on the neck and lower limb.
Considering the facts aforesaid and nature of allegation, I am not inclined to enlarge the petitioner abovenamed on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
