The petitioner seeks bail in connection with Daudnagar P. S. Case No.481 of 2020, instituted for the offences under Sections 307, 323, 341, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.
The learned senior counsel for the petitioner submits that the petitioner is in custody since 05.01.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.
The learned senior counsel for the petitioner further submits that allegation against this petitioner is of firing hitting the neck of the informant.
Patna High Court CR. MISC. No.34390 of 2021(3) dt.03-01-2022 2/3 The learned senior counsel for the petitioner submits that the injury report of the informant at Daudnagar hospital does not support the prosecution version as incised wound was found on the neck and he was referred to high centre.
The learned senior counsel submits that the informant went to Ford Hospital (private hospital) where he managed the injury and got it recorded as firearm injury. The learned counsel, thus, submits that the government hospital had recorded about incised would and the private hospital records firearm injury. This in itself shows that the informant tried to manage the private hospital Learned A.P.P. opposes the bail application.
Considering the fact that the petitioner is in custody, he is a person with clean antecedent, charge-sheet has been submitted in this case and the government hospital records incised wound, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1st , Daudnagar, Aurangabad in
Patna High Court CR. MISC. No.34390 of 2021(3) dt.03-01-2022 3/3 connection with Daudnagar P. S. Case No.481 of 2020, subject to condition that one of the bailors shall be the father of the petitioner.
