This application for anticipatory bail arises out of Shakurabad P. S. Case No. 31 of 2012, disclosing offences under Sections 363, 366A/34 of the Indian Penal Code. The petitioner is a lady. The First Information Report was registered in the year 2012. She has been declared absconder. Learned counsel for the petitioner informs that in the meanwhile, the co-accused Arbind Kumar, who happened to be the main accused was put on trial and he came to be acquitted at the trial by judgment dated 30.08.2013. Since the petitioner has been declared to be absconder, this application for anticipatory bail cannot be maintained. This application is, accordingly, dismissed.

Patna High Court Cr.Misc. No.46293 of 2017(3) dt.22-12-2017 2/2 Petitioner is directed to surrender before the Court below, if so advised. If she does so, her application for regular bail shall be considered on the same day on its own merit without being prejudiced by rejection of the present anticipatory bail application by this Court.
