JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-11-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 153A,153B and 379/34 of the Indian Penal Code and section 11(i) of the Prevention of Cruelty to Animal Act.
The prosecution case is that the villagers noticed that bones, skin and other parts of cow were lying when it was suspected that the petitioners chopped off cow. It is submitted by the learned counsel for the petitioners that only on suspicion the accusation has been levelled and there is no recovery from the petitioners.
Considering the suspicious nature of accusation and petitioners having no criminal antecedent, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve
Patna High Court Cr.Misc. No.53130 of 2015 (2) dt.23-11-2015 2/2 weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Patnacity in connection with Gaurichak P.S. Case No.118 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
