Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 20-10-2020 Heard Mr. Shailendra Kumar Dwivedi, learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Darauli P. S. Case No. 211 of 2019 dated 17.12.2019, instituted for offences under Sections 272, 273, 420 and 120 (B) of the Indian Penal Code and Sections 30 (a), 38 (1) and 41(1) of the Bihar Prohibition and Excise Act, 2016.

It appears from the F.I.R. that approximately 7300 litres of liquor was recovered from an unused drain. The petitioner and one Lorik Rai are said to have

Patna High Court CR. MISC. No.26994 of 2020(2) dt.20-10-2020 2/2 stored the aforesaid liquor in the dry drain. Lorik Rai @ Lorik Yadav has been granted bail by a Bench of this Court, which order has been annexed as Annexure- 2 to this petition.

The petitioner is in custody since 17.01.2020. Considering the period of custody of the petitioner and the fact that a similarly situated accused person has been granted bail, the petitioner, abovenamed, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge -II- cum - Special Judge Excise, Siwan in connection with Darauli P. S. Case No. 211 of 2019. The petition stands allowed.
