This application for anticipatory bail arises out of Ariyari P.S. Case N0. 104 of 2017, disclosing offences under Sections 406,409,420,467,468,471 read with Section 34 of the Indian Penal Code.

Learned counsel for the petitioner has produced before me an order, dated 31.10.2017, passed in Cr. Misc. No. 40537 of 2017 and Cr. Misc. No. 40877 of 2017 to submit that similarly circumstanced co-accused persons have been granted anticipatory bail. He has also referred to order, dated 04.10.2017 passed in Cr. Misc. No. 47323 of 2017. Considering the above submission, this application is

Patna High Court Cr.Misc. No.48869 of 2017(2) dt.21-11-2017 2/2 allowed.

Let the petitioner above named in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Sheikhpura in Ariyari P.S. Case No. 104 of 2017( G.R. No. 860 of 2017), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
