Criminal Miscellaneous No.53848 of 2015 Arising Out of PS.Case No. -63 Year- 2014 Thana -KURTHA District- JEHANABAD ====================================================== Chhotu Kumar @ Naga Sharma S/o Raj Kishore Sharma, R/o VillageOrbigha, P.S.- Banshi, District- Arwal. .... .... Petitioner/s

Versus

The State of Bihar .... .... Opposite Party/s ====================================================== CORAM: HONOURABLE MR. JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 17-02-2016 Heard the counsel for the petitioner as well as Mr. Sanjay Kumar Tiwary, APP for the State.

The petitioner seeks anticipatory bail in Kurtha (Manikpur) P.S. case no. 63/14 registered under Sections 307, 326(A), 379/34 of Indian Penal Code. Section 302 IPC was later added.

The two sisters were returning home from Kurtha Market and as soon as they reached Khatangi Sun Temple all of sudden, two unknown miscreants are said to have snatched her mobile and sprinkled acid like substance on one sister who subsequently died.

From the impugned order, it appears in course of investigation materials have been collected incriminating the petitioner in the crime.

Patna High Court Cr.Misc. No.53848 of 2015 (3) dt.17-02-2016 Considering the submissions made by the petitioner and on perusal of the FIR, I do not find it to be a fit case for grant of anticipatory bail. Prayer is accordingly rejected. Petitioner may surrender and pray for regular bail which shall be considered and disposed of on its own merit in accordance with law.
