JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 02-02-2022 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. The petitioner is apprehending her arrest in a case registered for the offence punishable under Sections 302, 120B, 34 of the Indian Penal Code.
Petitioner is said to have committed murder of the daughter of the informant by pressing neck.
Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. He submits that petitioner is the elder sister-in-law (Gotani) of the deceased and she lives separately from the deceased's family. He submits that the husband of the deceased is in custody as stated in para-20 of this application. He further submits that petitioner has no criminal antecedent as stated in para-3 of this application.

No.34436 of 2021(2) dt.02-02-2022 2/2 However, learned APP for the State opposes the prayer for bail and submits that there is specific allegation against the petitioner and husband of the deceased. Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, her prayer for anticipatory bail is rejected in connection with Panapur P.S. 18 of 2020.
However, if the petitioner surrenders before the learned court below within a period of six weeks from today and prays for regular bail, the same shall be considered by the learned court below on the same day.
