Petitioner seeks direction for re-measurement of a height and if he is found to be more than 165 cm then to appoint him on the post of Constable on the basis of marks obtained by him in the written examination pursuant to the advertisement no. 2/09.

A counter affidavit has been filed on behalf of respondent stating that his height is found to be less than 165 cm, therefore, he is declared disqualified. It is stated in para 10 of the counter affidavit that petitioner's height was measured and was found to be 164.5 cm as per the Physical Evaluation Sheet

Patna High Court CWJC No.18540 of 2010 (2) dt.25-02-2016 appended as Annexure C. The petitioner thereafter filed appeal on 25.09.2010 which was registered vide appeal register serial no. 333 of the Board and on the same day, his height was re-measured before the Chairman of the Board and it is found to be 164.5 cm. The claim of the petitioner that his height is 166 has been found to be false and copy of the re-measurement dt. 25.09.2010 appended as Annexure D.

In above view of the matter, this court does not find this case to be fit warranting its interference. Accordingly, this writ application is dismissed.
