JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-11-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Bakhtiyarpur P.S. Case No.45 of 2020 for the offence under Sections 420, 467, 468 and 471 of the Indian Penal Code and Section 25(1-B)a of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 14.02.2020.

The allegation against the petitioner is that he has used the forged gun licence at the time of seizure of the gun. Learned counsel appearing on behalf of the petitioner submits that the petitioner is working as Guard and he was accompanying his master and he was apprehended for allegedly

Patna High Court CR. MISC. No.27216 of 2020(2) dt.02-11-2020 2/2 using the forged gun licence issued from Udhampur (Jammu & Kashmir). Petitioner is in custody since 14.02.2020. Considering the fact that the petitioner has no criminal antecedent and he has remained in custody for nearly 11 months, the Court is inclined to grant bail to him. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Barh in connection with Bakhtiyarpur P.S. Case No.45 of 2020.
