JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-11-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Special Case No.2066 of 2020 arising out of Fatuha P.S. Case No. 157 of 2020 for the offences under Section 30(a) of the Bihar Prohibition & Excise Act, 2016and Sections 25(1-b)a, 26 and 35 of the Arms Act.

Learned counsel appearing on behalf of the petitioner would submit that the petitioner has no criminal antecedent and he is in custody since 29.02.2020.

In the instant case total 41.625 litres of foreign liquor was seized and during course of seizure, one county made pistol with live cartridges was recovered from co-accused Vishal Kumar, who is the brother of the petitioner.

No.27220 of 2020(2) dt.02-11-2020 2/2 Considering the fact that the petitioner has no criminal antecedent and he is in custody since 29.02.2020, the Court is inclined to grant bail to him subject to the condition that the petitioner has to deposit Rs.25,000/- in cash. On depositing the amount of Rs.25,000/-, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Special Judge (Excise), Patna in connection with pecial Case No. 2066 of 2020 arising out of Fatuha P.S. Case No. 157 of 2020.

Deposit of Rs.25,000/- (Rupees twenty five thousand) shall abide by final outcome of the instant criminal case. (Anil Kumar Upadhyay, J) BT/- U T
