1. Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 272, 273,34 of the Indian Penal Code and 30(a) of the Bihar Prohibition and Excise Act.

3. Total 417 litres of foreign liquor has been recovered from Bolero.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner has got no criminal antecedent.

5. Learned counsel for the State opposes the bail

Patna High Court CR. MISC. No.29822 of 2023(3) dt.17-07-2023 2/2 petition of the petitioner and submits that petitioner is the registered owner of the vehicle in question.

6. Considering the facts of the case as also the fact that huge quantity of liquor has been recovered from the vehicle of which petitioner is registered owner, prayer for anticipatory bail is rejected.
