The appellant is apprehending his arrest in SC/ST P.S.Case no. 26 of 2017 registered under Sections 341, 323, 504, 506 and 354 of the Indian Penal Code and 3(i) (x) (W1) (Va) SC/ST Act, pending in the court of learned Special Judge (SC/ST Act),Gaya.
Allegation against the appellant is of abusing the informant by taking her caste name.
Submission of the learned counsel for the appellant is that the field belongs to the appellant and she is forcibly trying to capture his field saying herself as Bataidar and lodged a case against the appellant. It is further submitted that earlier to lodging
Patna High Court CR. APP (SJ) No.2374 of 2017 (2) dt.24-08-2017 2/2 this case, the appellant has lodged an informatory petition before Sr.S.P., Gaya.
Heard Special P.P. also, who has opposed pre arrest bail of the appellant on the ground of maintainability. Having heard both the sides and in view of the facts and circumstances of the case let the above named appellant surrender in the court below within a period of four weeks and pray for regular bail which shall be considered by the learned court below specially on the ground that the field belongs to the appellant and pass an appropriate order as he thinks fit and proper if possible preferably on the same day.
