No one appears on behalf of the State.

The petitioner prays for grant of anticipatory bail in Bettiah Muffasil (Banuchhapar) P.S. Case No. 240 of 2016 registered under sections 413, and 414/34 IPC. On secret information, the Police Officer constituting a team raided the place. Four miscreants seeing the police tried to flee away. Two of them made good their escape. Rest two were arrested who disclosed the name of the petitioner and others who escaped from the place of occurrence. The police suspected that they were part of the gang involved in commission of theft of motorcycles and selling them in Nepal.

Patna High Court Cr.Misc. No.37706 of 2016 (3) dt.21-11-2016 2/2 The contention of the petitioner is that except the confessional statement, there is no other incriminating material against the petitioner.

From the bail petition, it appears that the petitioner is also accused of similar nature of case vide Harsidih P.S.Case No. 78 of 2016 registered under section 414 IPC.

Looking to the allegation contained in the FIR and other materials reflected from the records as also the criminal antecedents of the petitioner, in my view, he does not deserve anticipatory bail. Prayer is accordingly rejected. Let the petitioner surrender and pray for bail which shall be considered and disposed of on its own merit in accordance with law.
