The petitioner apprehends his arrest in Maniyari P.S. Case No. 62/2016, registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 47A of the Excise Act.

The informant police officer lodged the case alleging therein that on information, a hut was raided in the presence of independent witnesses and two litres of sprit was found. The people disclosed that the hut belongs to the petitioner Sanjay Sah. Learned counsel for the petitioner submits that the petitioner has got no manner of concern with the hut. There is nothing on record to show that petitioner was running countrymade liquor.

No.41407 of 2016 (2) dt.22-11-2016 2/2 Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate Ist Class, Muzaffarpur in connection with Maniyari P.S.
