The petitioner apprehends his arrest in connection with Muffasil P.S. Case No. 120 of 2016 registered under Sections 363 and 366A of the Indian Penal Code.
The accusation is of kidnapping of daughter of the informant by the petitioner and two others namely Banti Mandal and Ravi Mandal with intention to perform marriage. Learned counsel appearing on behalf of the petitioner submits that in fact, there was love affairs in between the daughter of the informant and co-accused Ravi Mandal and accordingly, daughter of the informant left her house according to her sweet will and moved with Ravi Mandal at Munger and
Patna High Court Cr.Misc. No.44360 of 2016 (2) dt.22-10-2016 2/2 performed marriage. The victim, daughter of the informant, herself stated her aged as 18 years at the time of recording her statement under Section 164 Cr. P.C. and her age was also assessed as 18 years.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Munger in connection with Muffasil P.S. Case No. 120 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J) Shail/- U T
