The instant Appeal has already been dismissed for default due to noncompliance of Court's order dated 25.02.2011. It is submitted on behalf of the appellants that he has complied the order. It appears that though the order has been complied, but not within time, resulting, the Memo of Appeal stood rejected.
On behalf of the respondents no. 1 & 2, Vakalatnama has been filed and a petition has been filed being I.A. No. 6239 of 2016 praying therein to return the statutory amount of Rs. 25,000/- (rupees twenty five thousand) to the learned Tribunal, so that the same may be handed over to the claimant no.1 after proper identification. Prayer is allowed. Let the statutory amount so deposited be returned to the learned Tribunal to hand over the same to claimant no.1.
Patna High Court MA No.109 of 2010 (4) dt.30-08-2016 2/2 The Oriental Insurance Company Ltd. is directed to pay the balance amount of Award within two months to the claimant no.1, as claimant no.3 is reported to be dead and in this regard death certificate has also been filed with I.A. No. 6239 of 2016 showing Harey Ram Singh @ Haldhar Prasad Singh dead. The claimant no.2 is minor son of claimant no.1. Accordingly, this M.A. case is hereby disposed of. (Jitendra Mohan Sharma, J.)
