JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-12-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 468, 420 of the Indian Penal Code.

It is alleged against the petitioner that petitioner submitted a money receipt No. 940549 dated 28.06.2003 in his name showing the proof of the payment of the energy charges but the said receipt was actually issued in the name of Ram Rup Bhagat.

It is submitted by learned counsel for the petitioner that the First Information Report does not reflect that the said receipt was submitted by the petitioner and even if that receipt is actually with regard to the payment of energy charges made by Ram Rup Bhagat then it will create civil liability against the petitioner.

No.54699 of 2015 (2) dt.03-12-2015 2/2 Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Munger in connection with Kharagpur P.S. Case No. 202 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
