The petitioner seeks bail in connection with Sadar P.S. Case No. 87 of 2016 for the offence registered under section 395 of the Indian Penal Code.

The case of the prosecution is that the informant is said to have been surrounded by three motorcyclists and thereafter the miscreants had taken out the bag as well as had snatched mobile phone and cash of from the pocket of the informant. The FIR is said to have been filed against unknown person. The learned counsel for the petitioner submits that since the petitioner was in custody in connection with another case, the Police have implicated him in the present case upon confessional statement of one co-accused Madhav Kumar,

Patna High Court Cr.Misc. No.9524 of 2018 (4) dt.06-04-2018 2/2 however, neither the petitioner has got anything to do with the alleged occurrence nor any recovery has been made from his possession.

Having regard to the facts and circumstances of the case, I deem it fit and proper to admit the petitioner herein to the privilege of anticipatory bail in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Sadar P.S. Case No. 87 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
