2. The petitioner is apprehending his arrest in connection Saharghat P.S. Case No. 78 of 2019, F.I.R. dated 27.06.2019 for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.
3. According to prosecution case, there is recovery of 27 litres of Nepali illicit liquor.
4. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case. He further submits that the allegation as alleged in the F.I.R. is false and fabricated and the petitioner has not committed any offences as alleged in the
Patna High Court CR. MISC. No.25084 of 2025(2) dt.07-05-2025 2/2 F.I.R. Although, the petitioner sold the motorcycle in qeustion but it appears from the Annexure-2 Series that that petitioner has annexed the forged papers one is of 2015 and the second is of 2019.
5. The learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner.
6. Considering the allegation as alleged in the F.I.R and the material available on record, I am not inclined to grant the privilege of anticipatory bail to the petitioner in connection with Saharghat P.S. Case No. 78 of 2019 pending in the court of Additional Sessions Judge-II-cum-Special Judge Excise Act, Madhubani.
7. Prayer is refused.
