JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-01-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 406 and 420/34 of the Indian Penal Code.
Heard learned counsel for the petitioner.
It has been submitted on behalf of the petitioner that as per complaint petition complainant had given Rs. 2 lacs to the petitioner and his brother and both are accused in the complaint case. It has further been submitted that brother of the petitioner was directed by a Bench of this Court to deposit Rs.2 lacs which he had deposited in the court below and provisional anticipatory bail granted to the brother of the petitioner was confirmed.
Patna High Court Cr.Misc. No.48654 of 2016 (3) dt.12-01-2017 2/2 On perusal of the record of Cr. Misc. no. 54002 of 2013 it appears that on conditional payment of Rs.2 lacs, provisional anticipatory bail granted to the brother of the petitioner had been confirmed.
Heard learned A.P.P. also.
Having heard both sides, in view of the fact that on perusal of Cr. Misc. no. 54002 of 2013 it appears that the aforesaid amount had already been deposited in favour of the informant, let above named petitioner, in the event of arrest or surrender within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Laheri P.S. Case no. 143 of 2013 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. Accordingly, this application is allowed.
