The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 147 and 307 of the Indian Penal Code. It is alleged that the petitioners along with co-accused assaulted the father of the informant with Khanti when the mother of the informant and informant came to rescue they were also assaulted.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.54051 of 2015 (2) dt.27-11-2015 2/2 petitioners that on conclusion of the investigation only Sanjay Yadav was charge-sheets and petitioners were not sent up for trial. Statement to that effect has been made in paragraph 12 of the petition. There is a counter version of the occurrence and a statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Jehanabad in connection with Kako P.S. Case No. 128 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
