JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 05-04-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Ashok Paper Mill (A.P.M.) P.S. Case No. 1 of 2018 registered under Sections 306 and 201 of the Indian Penal Code. It is submitted by the learned counsel for the petitioner that initially a case of unnatural death was registered on the basis of the statement of the petitioner regarding death of her daughter, but after inquiry, the police registered an FIR on 03.01.2018 under Sections 306 and 201 of the Indian Penal Code with respect to an alleged occurrence of offences

Patna High Court Cr.Misc. No.18116 of 2018 (2) dt.05-04-2018 on22.04.2017 alleging therein that the petitioner being mother has chastised her daughter as a result of which, she committed suicide.

Learned counsel for the petitioner submitted that even if the said version of the police is believed to be true, it cannot be said that the petitioner abetted the victim to commit suicide.

Learned counsel for the State opposed the application for grant of pre-arrest bail to the petitioner. Having regard to the submissions made above, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VI, Darbhanga in connection with Ashok Paper Mill (A.P.M.) P.S. Case No. 1 of 2018 subject to the conditions as laid down under Section 438(2) Cr. P.C.
