JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-10-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 366A/34 of the Indian Penal Code.

As per the prosecution case, this petitioner along with other FIR named accused persons, on the point of pistol, kidnapped the minor daughter of the informant. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. The victim had love affairs with Button Paswan, who is nephew of the petitioner, and in fact the victim fled away with Button Paswan and they are living at Punjab. Petitioner is in custody since 03.01.2021.

Learned counsel appearing for the State opposes the

Patna High Court CR. MISC. No.34871 of 2021(3) dt.21-10-2021 2/2 prayer for bail and submits that victim is still traceless and there is specific allegation against this petitioner and other accused persons they that kidnapped the minor daughter of the informant on the point of pistol.

Considering the facts of the case and the nature of accusation made against this petitioner and the fact that victim is still traceless, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
